TERMS AND CONDITIONS

By completing your order through NVTHREADS for the purchase of CHUKAR CHASERS products and/or gear and using this site, you agree to comply with and be bound by the following terms and conditions of sale, as well as consent to the privacy policy described below.  From here on “you” or “your” refers to the customer.

Misplaced Goods, Misplaced Decimal Places or Otherwise. If, by genuine mistake, CHUKAR CHASERS have underpriced an item, it will not be liable to supply that item to you at the stated price, provided that CHUKAR CHASERS notify you before the products and/or gear is ship. In those circumstances, NVTHREADS/CHUKAR CHASERS will notify the correct price to you so you can decide whether or not you wish to order the item at that price.

Artwork and Designs. NVTHREADS distributes the CHUKAR CHASERS brand which carries both local and federal protections of its intellectual property (“IP”) and may not be used in any other form without the prior written consent by CHUKAR CHASERS.  Any unauthorized use by individuals and/or companies of its IP will be held liable to the fullest extent permitted by law for the unauthorized use of copyrighted, trademarked or otherwise licensed logos, designs or artwork.

Returns. Refunds and/or returns of products are not possible.  CHUKAR CHASERS will accept no returns of its products and/or gear for any reason; therefore you are encouraged to fully consider all specifications, sizes, and colors of your order.

Shipping. The liability for loss or damage in transit, or thereafter, shall pass to the customer upon the delivery of the order to a common carrier for shipment, e.g. United States Postal Service (“USPS”).  Shipping dates are approximate and are based, to a great extent, on prompt receipt by NVTHREADS of all necessary ordering information from you.  

CHUKAR CHASERS shall not be in default by reason of any failure in its performance under this Agreement if such failure results from, whether directly or indirectly, fire, explosion, strike, freight embargo, Act of God or of the public enemy, war, civil disturbance, act of any government, de jure or de facto, or agency or official thereof, material or labor shortage, transportation contingencies, unusually severe weather, default of any other manufacturer or a supplier or subcontractor, quarantine, restriction, epidemic, or catastrophe, lack of timely instructions or essential information from you, or otherwise arisen out of causes beyond the control of NVTHREADS/CHUKAR CHASERS. Nor shall NVTHREADS/CHUKAR CHASERS at any time be liable for any incidental, special or consequential damages.  

The customer shall be responsible for payment of all charges and taxes.  The risk passes to the buyer upon leaving NVTHREADS and on delivery to a common carrier, e.g. USPS. 

NV THREADS/CHUKAR CHASERS are not liable for any losses in transit.

Delays Beyond Our Control. CHUKAR CHASERS shall have no liability to you for any failure or delay in the delivery of goods ordered, or for damage or defect to goods caused by events or circumstances beyond reasonable control.

Packaged Deliveries. Orders will arrive boxed unless stated otherwise.  Mistakes do happen, if you receive incorrect or damaged goods then please contact NVTHREADS and/or CHUKAR CHASERS within one (1) business day from receipt so that NVTHREADS/CHUKAR CHASERS can rectify the problem.

Exclusion of Liability. NVTHREADS/CHUKAR CHASERS shall not be liable in any way for any loss of revenue, profit, goodwill or any consequential or indirect or special loss or damage arising out of the purchase of any goods by you from CHUKAR CHASERS or late or non-delivery of goods. NVTHREADS/CHUKAR CHASERS does not accept liability for any loss from claims of third parties arising out of the use of Goods or Services purchased from us.  NVTHREADS/CHUKAR CHASERS shall not be liable for any misrepresentations. NVTHREADS/CHUKAR CHASERS accept zero liability for all losses not specifically mentioned here, as well as any liability for health issues that may occur from the use of products supplied to you by us.

Warranty. NVTHREADS/CHUKAR CHASERS will endeavor to provide the highest quality goods as standard, and these will arrive in a merchantable quality. However, unless expressed at point of purchase, there is no warranty provided, beyond manufacture defects, with purchases made through NVTHREADS.  Any wear and tear or depletion of goods due to use and wear are not the responsibility of NVTHREADS/CHUKAR CHASERS, and NVTHREADS/CHUKAR CHASERS, will not be obliged to replace or refund any goods.

Liability. NVTHREADS/CHUKAR CHASERS will not accept any liability for loss or profit or consequential losses suffered as a result of erroneous delivery, production or delivery delay, or otherwise. The risk inherent in all goods passes to the customer as soon as production is complete and the order is dispatched.

Governing Law.  The purchase of products and/or gear creates a contract between you and CHUKAR CHASERS and shall be governed by and interpreted by the laws of the State of Nevada.

Intellectual Property. All intellectual property (“IP”) associated with the CHUKAR CHASERS brand, supply chain, processes and all other relevant elements of its business will remain CHUKAR CHASERS.  Customers have no right to use CHUKAR CHASERS without written permission.  Any attempt to duplicate or reproduce any portion of any product and/or gear without previous written consent is forbidden and violators will be prosecuted to the fullest extent permitted by law.

Application of this Policy. NVTHREADS respects your privacy and is committed to protecting it through our compliance with this policy.  NVTHREADS is the “controller” of your information.  That means it is responsible for how your information is processed.  Any questions you have should be sent to: info@nvthreads.com.

This policy describes the types of information we may collect from you or that you may provide when you visit the CHUKAR CHASERS website “GEAR” page (“WEBSITE”) and our practices for collecting, using, maintain, protecting and disclosing that information.  Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with our policies and practices, your choice is not to use our WEBSITE.  By accessing or using this WEBSITE, you agree to this privacy policy.

Information Collected and Privacy Protection. NVTHREADS collects information from purchasers and customers visiting the www.chukarchasers.com, and its affiliated websites.  We collect several types of information from and about users of this WEBSITE, including the following:

1. information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, (“personal information”); and/or
2. information about your access to this WEBSITE and usage details.

We collect this information directly from you when you provide it to use and/or automatically as you navigate through this WEBSITE. 

Information you Provide to Us. The information we collect on or through this WEBSITE may include:

1. information that you provide by filling in forms on this WEBSITE. This includes information provided at the time of registering to use this WEBSITE or placing an order on this WEBSITE;
2. information when you enter a contest or promotion sponsored by CHUKAR CHASERS;
3. records and copies of your correspondence (including e-mail addresses), if you contact NVTHREADS and/or CHUKAR CHASERS, such as when you report a problem with this WEBSITE or other products or services; and/or
4. details of transactions you carry out through this WEBSITE and of the fulfillment of your orders. You may be required to provide financial information before placing an order through this WEBSITE.  If you purchase a product from us, your card information is not held by us; it is collected by our third-party payment processor, who specializes in the secure online capture and processing of credit card transactions.

Analytics data. As you navigate through and interact with this WEBSITE, we may use automatic data collection technologies to collect certain information such as details of your visits to this WEBSITE, including traffic data, logs and other communication data and the resources that you access and use on this WEBSITE.  The information we collect automatically is statistical data which helps us to improve this WEBSITE and to deliver a better and more personalized service.

How We Use Your Information. We only use information we collect from you for as long as it is reasonably required for a legitimate business purpose.  We review our retention periods for personal information on a regular basis.  We are legally required to hold some types of information to fulfill our statutory obligations, such as for tax records.  We will hold your personal information on our systems for as long as necessary for the relevant activity.  We may use information that we collect about you or that you provide to us, including any personal information in one of the following ways:

8. in any other way, we may describe when you provide your information; and/or
9. for any other purpose with your consent.

We may also use your information to contact you about our goods and services that may be of interest to you.  If you do not want us to use your information in this way, please adjust your user preferences in your account profile.

Accessing Your Information. You have the right to ask for a copy of the information we hold about you (we may charge you a small processing fee for information requests to cover our cost of providing you with details of the information we hold about you.

Data Security. NVTHREADS implements a variety of security measures to maintain the safety of all customers’ personal information when accessing this WEBSITE and entering your personal information for purchases of products and/or gear and seeks to protect the integrity of its site.  We implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure.

The safety and security of your information also depends on you.  Where we have given you (or where you have chosen) a password for access to certain parts of this WEBSITE, you are responsible for keeping this password confidential.  We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to this WEBSITE.  Any transmission of personal information is at your own risk.  We are not responsible for circumvention of any privacy settings or security measures contained on this WEBSITE.  If a data breach occurs, we will notify you and the proper European Economic Authority (if required) within seventy-two (72) hours (if reasonably feasible).

Transferring Information Outside of Europe. As part of the services offered to you through this WEBSITE, the information which you provide to use may be transferred to the United States. We are committed to keeping this information.

EU/US and Swiss-US Privacy Shield Frameworks. We comply with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, please visit: www.privacyshield.gov.  Personal data from the European or Switzerland and/or on EU or Swiss citizens may be collected by NVTHREADS and may be stored and processed in the United States.

In compliance with the US-EU Privacy Shield Principles and the Swiss-US Privacy Shield Principles, we commit to resolve complaints about your privacy and our collection or use of your personal information (using the dispute resolution procedure set forth above).  You have the right to access your personal data, and to have the data corrected, amended or deleted where it is inaccurate or processed in violation of the Privacy Shield Principles (as described in detail above).
